A legal separation is similar to a divorce in that a legal arrangement is made regarding the division of property, child custody, visitation, spousal support and child support, however, the two parties will remain legally married. A legal separation is often preferable in situations where the couple wishes to keep the legal status of the marriage in place for a variety of reasons including children, religious purposes or maintaining health insurance for a spouse. For instance, if in the military, under the 20/20/20 rule, a spouse might have lifetime medical care if the marriage is maintained for twenty years.
